What is this right?

The Consumer Protection Act, 2019 gives every consumer the right to file a complaint against a seller, manufacturer, or service provider for defective goods or deficient services.

  • Who is a consumer: Any person who buys goods or hires services for personal use (not for resale or commercial purpose). Online buyers are explicitly included.
  • Grounds for complaint: Defective product, deficiency in service, unfair trade practice (e.g., false advertising), restrictive trade practice, overcharging, and hazardous products.
  • Three-tier redressal system:
    • District Consumer Disputes Redressal Commission (DCDRC): Claims up to ₹50 lakh. Filing fee: ₹200–₹2,000 (tiered by claim amount).
    • State Consumer Disputes Redressal Commission (SCDRC): Claims between ₹50 lakh and ₹2 crore, and appeals from DCDRC.
    • National Consumer Disputes Redressal Commission (NCDRC): Claims above ₹2 crore, and appeals from SCDRC.
  • e-Daakhil: Consumer complaints can now be filed online at edaakhil.nic.in — no need to visit the commission physically.
  • Limitation: Complaints must be filed within 2 years of the cause of action (delay can be condoned for sufficient cause).
  • No court fees for Class Action suits (product liability complaints involving multiple consumers can be filed together).

When does it apply?

  • You purchased a product that is defective or dangerous.
  • A service provider (hospital, builder, bank, insurance company, telecom) has provided deficient service.
  • You have been charged more than the MRP (maximum retail price) or misled by advertising.

What to Do If a Seller or Service Provider in India Wrongs You as a Consumer

  • First, send a written legal notice to the seller/service provider giving them 15–30 days to resolve the issue — many disputes are settled without going to the commission.
  • If unresolved, file a complaint on edaakhil.nic.in — include a copy of the legal notice, proof of purchase (invoice/bill), communication records, and supporting evidence (photos, test reports).
  • You can also file complaints on the National Consumer Helpline: 1800-11-4000 (toll-free) or the NCH portal (consumerhelpline.gov.in) — mediators help resolve many disputes without formal proceedings.
  • Commissions can award compensation, replacement, refund, and also punitive damages for egregious conduct.

What should you NOT do?

  • Do not file in a commission beyond your claim jurisdiction — a ₹10 lakh claim must go to the DCDRC, not the NCDRC, to avoid delays and jurisdictional objections.
  • Do not miss the 2-year limitation — if you are close to the deadline, file first and explain any delay in the complaint itself.
  • Do not accept unsatisfactory repairs or replacements as a "full and final" settlement unless you are genuinely satisfied — signing such a document extinguishes your claim.

How Kerala differs from central law

Consumer complaints in Kerala are handled by the three-tier Consumer Disputes Redressal system under the Consumer Protection Act, 2019. The Kerala State Consumer Disputes Redressal Commission is based in Thiruvananthapuram, with District Consumer Disputes Redressal Forums in all 14 districts.

District Forums handle complaints where the value of goods or services and compensation claimed does not exceed Rs. 1 crore. The State Commission handles complaints between Rs. 1 crore and Rs. 10 crore, and appeals from District Forum orders. Kerala's consumer forums are among the more active in India, with relatively faster disposal rates.

Kerala also has a strong cooperative consumer movement. The Kerala State Cooperative Consumer Federation (Consumerfed) operates a network of retail outlets that provide consumer goods at fair prices, and its existence provides an alternative marketplace that helps regulate pricing. The Kerala Consumer Protection Rules complement the central Act and provide state-specific procedures.

Filing through e-Daakhil — step by step: The National Informatics Centre's e-Daakhil portal (edaakhil.nic.in) is the official online platform for filing consumer complaints in Kerala. To file: (1) register with mobile OTP and PAN, (2) select the correct forum by pecuniary value — District (up to Rs 50 lakh), State Commission (Rs 50 lakh to Rs 2 crore), or NCDRC (above Rs 2 crore), (3) upload the cause-of-action documents (invoice, correspondence, proof of deficiency), (4) pay the e-filing fee online — Rs 100 for claims up to Rs 5 lakh, Rs 200 for Rs 5-10 lakh, scaled upward. The filing fee is waived for Below Poverty Line (BPL) cardholders.

Limitation period — 2 years from cause of action (Section 69): A consumer complaint must be filed within 2 years from the date the cause of action arose (typically the date of defective delivery, denied refund, or latest written communication from the seller). Delay beyond 2 years is condonable only if the complainant proves 'sufficient cause' — a Kerala State Commission bench has repeatedly refused condonation for delays caused by simply pursuing customer care grievance loops.

Deemed admission and timelines: Under Section 38, the opposite party must file its written version within 30 days (extendable by 15 days only). Failure to reply triggers deemed admission of the complaint's factual assertions. Forums in Kerala (Ernakulam, Kozhikode, Thiruvananthapuram District Forums) are known to issue orders within 6-9 months where opposite parties fail to appear.
