Policing, Security and Community Safety Act 2024 (Act No. 1 of 2024), commenced 2 April 2025 + Garda Síochána Act 2005, Part 4 (transitional, pre-April 2025 complaints) + Constitution of Ireland, Articles 38.1 and 40
Your letter will be addressed to Fiosrú (Oifig an Ombudsman Póilíneachta), the statutory successor to GSOC, and will cite the operative framework based on the date of the incident.
Critical for the admissibility time limit and to determine whether your complaint is governed by PSCSA 2024 (on or after 2 April 2025) or the Garda Síochána Act 2005 (before that date).
Be specific. Include street, town/city, and any Garda station you were taken to.
Include badge / member numbers, patrol car registration, station, and physical descriptions. The more detail, the easier Fiosrú can identify the members.
Mandatory referral cases (death or serious harm in custody, fatal Garda-involved shootings, and others specified by the Act) must be referred by the Garda Commissioner to Fiosrú whether or not a member of the public complains.
