Your Situation

Tell us about the bailiff company, the debt being enforced, and what has happened so far. If a bailiff is at your door right now and refusing to show ID or threatening force against you, dial 999 — paragraph 24 of Schedule 12 means they have no power to use force against persons.

This letter will cite

TCEA 2007 Schedule 12 (paras 7, 18, 24, 26, 66) + SI 2013/1894 + SI 2014/1

Your letter will cite paragraph 26 (bailiff must on request show identity AND authority), paragraph 24 (no power to use force against persons — force against goods only), the 14/28-day Notice of Enforcement rule under paragraph 7 and SI 2013/1894 reg.6, the prohibition on taking control where a child or vulnerable person is the sole occupier under SI 2013/1894 reg.10, the fee revocation under SI 2014/1 reg.17, and the damages route under paragraph 66 (County Court for warrant-based, High Court for writ-based enforcement).

TCEA Sch.12 only extends to England & Wales. Scotland uses Sheriff Officers / Messengers-at-Arms under the Bankruptcy and Diligence etc. (Scotland) Act 2007 and the Debt Arrangement Scheme. Northern Ireland uses the Enforcement of Judgments Office (EJO).
