What is this right?
EOBI is the only nationwide, employer-funded pension scheme for private-sector workers in Pakistan, and unlike most labour laws it survived the 18th Amendment as a federal subject. The Employees' Old-Age Benefits Act 1976 covers any establishment with five or more workers, plus voluntarily-registered smaller ones. Employer pays 5% of the prevailing minimum wage and the worker pays 1%. The cap is the minimum wage even if you earn more, so the maximum monthly contribution is small and the eventual pension modest.
The old-age pension kicks in at 60 for men, 55 for women, with at least 15 years of insurable employment. The formula is roughly: (average wage of last 12 months × insurable years) ÷ 50, with a floor pegged to a notified minimum (raised to PKR 11,500/month from January 2025, periodically increased). On invalidity (loss of earning capacity ≥ 67%) and survivor (death of insured worker), the same formulas trigger earlier.
- Your EOBI registration number is unique and follows you from job to job. New employers should add you under your existing PI number, not create a fresh one. Check your registration at eobi.gov.pk using your CNIC.
- If your employer has not been depositing contributions, EOBI can recover them with surcharge under section 13 of the Act. The worker doesn't lose service for the employer's default, but you have to push EOBI to issue the recovery notice.
- Domestic, agricultural, and self-employed workers were excluded for decades. Self-employed voluntary registration was opened in 2018 but uptake is thin.
When does it apply?
- You worked in any establishment with 5+ employees in Pakistan, in any industry except those excluded by SRO (mostly federal/provincial government, where civil-service pensions apply).
- You are 60 (man) or 55 (woman) at the date of claim, OR have suffered ≥67% loss of earning capacity, OR you are the surviving widow/child/parent of an insured worker.
- You have at least 15 years of insurable employment recorded with EOBI (or qualifying years for invalidity/survivor cases).
What to do to claim your EOBI pension
- Verify your registration at eobi.gov.pk using your CNIC. Print the contribution history before applying — disputes about missing months are easier with a baseline.
- Collect documents: CNIC (original + 2 copies), 4 passport-size photos, all employer service certificates, last 12 months' wage slips, bank account details (the pension is paid directly to a bank account).
- File at your nearest EOBI Regional Office — list at eobi.gov.pk. Submit the relevant Form (PI-03 for old-age, PI-04 for invalidity, PI-05 for survivor).
- If contributions are missing for any period when you were employed, file a written representation. EOBI can recover from the defaulting employer with 8% surcharge. Don't accept "the employer didn't pay so you can't get pension" — that's wrong.
- If your claim is wrongly rejected, appeal first to the EOBI Adjudicating Authority within 30 days, then to the Adjudication Authority Tribunal under the Act.
What should you NOT do?
- Don't ignore years where the employer didn't register you. Push for retrospective registration with proof of employment (offer letter, pay slips, witness affidavits). EOBI Regulation 8 allows backdated entry on documentary proof.
- Don't apply without your service certificates. Apply once you have them in hand — EOBI returns incomplete files and the wait restarts.
- Don't give up after one rejection. EOBI Regional Offices are inconsistent; an Adjudication Tribunal appeal often reverses a wrong rejection.
Frequently asked questions
Can my employer dodge EOBI by calling me a contractor?
No. The Employees' Old-Age Benefits Act looks at the substance of the relationship, not the label. If you work fixed hours under supervision and use the employer's premises, you're an employee for EOBI purposes regardless of what the contract calls you.
I worked 14 years — is the pension lost?
Pension at 60/55 needs 15 years. Below that, you can claim a one-time old-age grant (commutation of contributions) under regulation 35. Invalidity and survivor benefits have lower service thresholds.
What if my employer never registered me?
Apply for retrospective registration with proof: offer letter, salary slips, ID card from the employer, witness affidavits. EOBI can register you backdated and recover dues from the employer with surcharge under section 13.
