What is this right?
The federal Dowry and Bridal Gifts (Restriction) Act 1976 capped total dowry-and-gifts value at Rs 5,000. The cap was unrealistic even in 1976 and has been ignored ever since. Yet the law's enforceability infrastructure — registration of dowry list, restitution on divorce, criminal liability for excessive demand — remains usable.
What works practically:
- Recovery of jahez articles from the husband's family at separation/divorce. Family Court has exclusive jurisdiction. The wife files a list of articles; the court orders return or money equivalent.
- Dowry death (suicide or murder due to dowry harassment) — PPC sections 304, 306, plus the broader 332 (hurt) and 506 (intimidation). Police are required to register an FIR.
- Dowry harassment alone — under provincial DV Acts (economic and psychological violence). Protection orders bar contact and demand.
The wife's jahez articles are her exclusive property under classical Hanafi law and codified Family Court practice. The husband is a custodian, not an owner. On separation, articles must be returned in specie (the same items) or, if disposed of, money equivalent at current value.
