What is this right?
A Singapore work pass is a privilege, not a right. The Ministry of Manpower (MOM), through the Controller of Work Passes, can refuse, suspend, or revoke any Employment Pass (EP), S Pass, Work Permit, EntrePass, Personalised EP (PEP), Tech.Pass, or ONE Pass. The governing law is the Employment of Foreign Manpower Act 1990 (EFMA):
- Employer must cancel within 7 days of the last day of notice (1 day if you leave Singapore permanently). Failure attracts a financial penalty up to S$10,000 under s 9(3).
- Short-Term Visit Pass after cancellation: MOM grants up to 90 days for EP, S Pass, PEP, and ONE Pass holders, and 30 days for Work Permit holders. You cannot work on an STVP.
- Only the employer or an authorised agent can appeal under EFMA s 7(5) — not the pass-holder personally. The window is 3 months for EP/S Pass/PEP/ONE Pass, and 30 days for Work Permit.
- No external appeals committee exists for pass issuance or revocation. The "appeal to the Minister" is handled internally by MOM, and the Minister's decision is final under s 7(5).
- Strong ouster clause (s 7(6)): Courts will not review the merits, except on procedural-compliance grounds. Stansfield and Manjit Singh preserve a narrow residual jurisdiction over natural-justice breaches.
- Parallel employment claims: Wrongful-dismissal and salary disputes run separately through the Tripartite Alliance for Dispute Management (TADM) and the Employment Claims Tribunal (ECT) — these are not foreclosed by an MOM appeal, and MOM will issue Special Passes so you can stay in Singapore to pursue them.
When does it apply?
- Your pass has been rejected, not renewed, suspended, or revoked — or your employer has terminated your employment and cancellation is pending.
- MOM has flagged an adverse record — false declaration, levy arrears, medical non-fitness (WP 6-monthly medical), or a COMPASS score below 40 points for EP.
- Your employer has been debarred, causing all associated passes to be revoked.
- You want to dispute a dismissal or claim unpaid salary while remaining in Singapore.
- You are a dependant whose Dependant's Pass or LTVP has been cancelled with the principal's pass (note: LTVP+ based on marriage to a Singapore Citizen is not cascadingly cancelled).
What to Do If Your Singapore Work Pass Has Been Rejected, Cancelled, or Not Renewed
- Check the cancellation advisory: Log in to the EP eService in myMOM Portal (EP/S Pass/PEP/ONE Pass) or WP eService (Work Permit, mandatory since 24 March 2025). Identify the exact reason.
- Tell your employer you want to appeal. Only they (or an authorised agent) can file. Provide new material information — a higher salary offer, updated qualifications, a stronger COMPASS score, or rebuttal of adverse records. MOM decides 85% of EP appeals within 6 weeks.
- File parallel employment claims at TADM within 1 month (wrongful dismissal) or 6 months / 1 year (salary). Mediation is mandatory before the ECT, which hears claims up to S$20,000 (S$30,000 with union mediation, S$250,000 for Workplace Fairness Act discrimination from 2025).
- Request a Special Pass from MOM to remain in Singapore while TADM mediation or ECT hearings are ongoing. TADM can also issue Change of Employer consent for salary-claim cases.
- Secure repatriation funding: Employers must bear your air ticket home plus connecting transport under EFMA's Fourth Schedule. For Work Permit holders the duty is strict; for EP/S Pass it can be contractually varied in writing.
- Get tax clearance (IR21): Your employer must file IR21 with IRAS at least one month before your last day and withhold final salary pending clearance.
- If you must leave: You can return to Singapore once any new In-Principle Approval comes through. Overstay attracts fines up to S$4,000 and up to 6 months' imprisonment — and over 90 days' overstay triggers mandatory caning under Immigration Act s 15.
What should you NOT do?
- Don't threaten judicial review of a COMPASS denial — EFMA s 7(6) ousts it, and no reported case since 2022 has succeeded on substantive grounds.
- Don't assume the MOM appeal replaces TADM. Miss the 1-month wrongful-dismissal deadline and you lose the employment claim, no matter how the MOM appeal ends.
- Don't rely on older guides claiming a 30-day STVP for EP holders — MOM's current policy is up to 90 days for EP/S Pass/PEP/ONE Pass.
- Don't overstay while waiting. If no new pass is issued before STVP expiry, leave Singapore — re-entry is possible once a new IPA is approved.
- Don't submit a repeat appeal without new information. MOM permits up to two EP appeals in the 3-month window, but only if each carries new material facts.
- Don't sign a termination release without understanding wrongful-dismissal rights. Section 14(2) Employment Act and the Tripartite Guidelines on Wrongful Dismissal (2019) apply to foreigners too; six months of service unlocks manager/executive claims.
