What is this right?
Carer's Allowance has a cliff-edge earnings rule: earn £1 over the weekly threshold (currently £196 net of allowable deductions, 2026/27) and you lose the whole allowance for that week. There is no taper. In late 2024 the National Audit Office confirmed that DWP had been flagging Carer's Allowance overpayments but failing to act on them — about 144,000 carers were sitting on accruing overpayments, some of them tens of thousands of pounds, before DWP belatedly started recovery.
Two things often save the carer in an overpayment dispute:
- Allowable deductions: pension contributions, half of childcare costs while at work, and 50% of expenses incurred to carry out duties (e.g. union subs, tools) can be deducted from gross earnings to bring you back under the threshold.
- DWP failure to act on reported information: if you reported the earnings change and DWP did nothing, the overpayment is recoverable under SSAA 1992 s.71, but the tribunal often finds the carer's reporting decisive on the cause question — which feeds into hardship and write-off arguments.
When does it apply?
- You received a Carer's Allowance overpayment letter from DWP.
- The earnings calculation is disputed, or you reported the change, or recovery is causing hardship.
- You are within 1 calendar month of the decision letter (extendable up to 13 months on special grounds under reg.5).
What to Do If DWP Says You've Been Overpaid Carer's Allowance
- Recalculate the weekly earnings yourself, deducting pension contributions, allowable childcare costs, and work expenses. The Carer's Allowance Unit often uses gross figures and misses deductions.
- If you reported the earnings change to the Carer's Allowance Unit, get the journal / call log. Quote the date and the channel.
- Send the MR letter to the address on the decision (Carer's Allowance Unit, Mail Handling Site A, Wolverhampton WV98 2AB is the routing on most letters — but use whatever's on yours).
What should you NOT do?
- Don't agree a repayment plan before contesting the figure — once you start paying, DWP treats the debt as accepted.
- Don't assume the £196 threshold is yours. Check the current figure — it rises in April each year.
