What is this right?
The UAE does not have a formal asylum or refugee system. It is not a signatory to the 1951 Refugee Convention or its 1967 Protocol. There is no legal procedure to apply for asylum or refugee status in the UAE. However, some limited protections exist:
- UNHCR presence: The UN High Commissioner for Refugees (UNHCR) has an office in Abu Dhabi and can register refugees and asylum seekers. However, UNHCR registration does not grant legal status in the UAE — it facilitates resettlement to third countries.
- Non-refoulement (limited): The UAE has ratified the UN Convention against Torture, which prohibits returning people to countries where they face torture. This provides some protection, though enforcement is discretionary.
- Temporary protection visas: In specific crises, the UAE has issued temporary residence permits to nationals of conflict-affected countries (e.g., Syrians, Yemenis, and Afghans). These are ad hoc decisions, not a permanent system.
