What is this right?
Central law caps daily and weekly working hours for workers in factories and, under the new codes, for establishments more broadly.
- Factories: Maximum 9 hours per day and 48 hours per week (s. 51, 54, Factories Act). A spread-over (start to finish) cannot exceed 10.5 hours without permission.
- Overtime: Any work beyond 9 hours/day or 48 hours/week must be paid at twice the ordinary wage rate (s. 59, Factories Act; s. 14, Code on Wages).
- Rest intervals: Workers cannot work more than 5 continuous hours without a half-hour rest break (s. 55, Factories Act).

How Tamil Nadu differs from central law
The Tamil Nadu Shops and Establishments Act, 1947 regulates working hours for employees in shops, commercial establishments, restaurants, theatres, and similar workplaces across the state.
- Maximum working hours: No employee in a shop or establishment can be required to work more than 8 hours per day and 48 hours per week.
- Spread-over: The work period including intervals for rest cannot exceed 12 hours in any day.
- Overtime (Section 31): Any work beyond normal hours — or beyond 48 hours in a week — must be paid at twice the ordinary wage rate (2×), not 1.5×. This is a common employer violation in Tamil Nadu: IT, BPO, and retail employers frequently pay overtime at 1.5× by wrongly applying the Factories Act rate or company policy. The Tamil Nadu S&E Act is explicit — double wages is the statutory floor.
- Supreme Court precedent: In Philips India Ltd. v. Labour Court, Madras (1985 AIR 1034), the Supreme Court confirmed that employees working beyond statutory hours are entitled to overtime at double wages under the TN S&E Act, and that contractual waivers of this right are void.
- Rounding of short overtime: Time worked beyond normal hours is usually counted in blocks of 15 or 30 minutes. Employers cannot refuse to pay overtime for stays of 20-40 minutes past shift end — if you are required or permitted to work, it counts.
- Weekly holiday: Every employee is entitled to at least one full day of rest per week, typically Sunday. Shops may choose an alternative day, but it must be consistent.
- Women employees: Women cannot be required to work before 6:00 AM or after 8:00 PM, except in IT/ITES establishments where exemptions apply if the employer provides transport and security.
- For factories, the Factories Act, 1948 applies. Tamil Nadu's Chief Inspector of Factories enforces the 48-hour weekly limit and mandatory rest intervals in factory premises.
