What is this right?

Kuwait law sets specific requirements for a valid marriage:

  • Both parties must give free consent to the marriage — forced marriages are not legally recognised.
  • The minimum marriage age is 15 for females and 17 for males, but a judge may grant exceptions.
  • A marriage contract must be registered with the Ministry of Justice through an authorised marriage official (ma'zoun).
  • The bride is entitled to a mahr (dower) — an agreed payment from the groom that becomes her personal property.
  • Kuwaiti men who wish to marry a non-Kuwaiti must obtain prior approval from the Ministry of Justice.
  • Marriages between a Muslim woman and a non-Muslim man are not permitted under Kuwaiti law.

When does it apply?

  • You plan to get married in Kuwait and need to understand the legal requirements.
  • You are a Kuwaiti citizen planning to marry a foreign national.
  • You want to register an existing marriage contracted abroad with Kuwait authorities.

What should you do?

  • Gather required documents — civil IDs, birth certificates, medical fitness certificates, and proof of nationality.
  • Apply for marriage approval at the Ministry of Justice.
  • If marrying a non-Kuwaiti, submit the permission application well in advance — processing can take several weeks.
  • Make sure the mahr amount is clearly stated in the marriage contract.

What should you NOT do?

  • Do not marry without registering the contract — unregistered marriages have no legal standing in Kuwait.
  • Do not skip the medical fitness test — it is a mandatory requirement.
  • Do not sign a contract you have not fully read — especially the mahr and conditions clauses.
