What is this right?
UAE tenancy law favours lease continuity and gives tenants strong renewal rights:
- Automatic renewal: If neither party gives notice, the lease automatically renews on the same terms and conditions.
- Tenant's right to renew: As long as you are paying rent and following the lease terms, you have a strong right to continue the tenancy.
- Landlord's notice to not renew: The landlord must give 12 months' notice (in Dubai) through a notary public or registered mail to end the lease.
- Early termination by tenant: If you want to leave before the lease ends, check your contract for an early termination clause. Typical penalties are 1-2 months' rent.
- Mutual agreement: Both parties can agree to terminate the lease early in writing at any time.
When does it apply?
- Your lease is approaching its end date and you want to renew or leave.
- You need to break your lease early.
- Your landlord has told you the lease will not be renewed.
What to Do If Your UAE Landlord Refuses to Renew Your Lease
- If you want to renew, do nothing — the lease renews automatically if neither party gives notice.
- If you want to leave, give notice as specified in your contract (typically 60-90 days before the lease end date).
- For early termination, negotiate with your landlord and get any agreement in writing.
- If the landlord refuses to renew without legal cause, file a case with the RDSC.
What should you NOT do?
- Do not just stop paying rent and leave — the landlord can cash your post-dated cheques or sue for the remaining lease amount.
- Do not assume you must leave just because the landlord says so — check if they have a legally valid reason.
- Do not forget to update your Ejari/Tawtheeq when the lease renews with new terms.
