What is this right?

Everyone in Oman has the right to a lawyer during criminal proceedings:

  • Right to a lawyer: You may hire a lawyer of your choice at any stage of the investigation or trial.
  • Court-appointed lawyer: In serious criminal cases (felonies), the court must appoint a lawyer for you if you cannot afford one.
  • Access during detention: You have the right to meet with your lawyer privately while in police custody.
  • Constitutional guarantee: The Basic Statute (Article 23) states that every accused person has the right to appoint a lawyer capable of defending them.

When does it apply?

  • You are arrested or summoned for questioning by the police or Public Prosecution.
  • You are charged with a felony — the court must provide you a lawyer if you do not have one.
  • You are a foreign national — you have the same right to legal representation.

What should you do?

  • Request a lawyer immediately upon arrest — state clearly that you want legal representation before answering questions.
  • If you cannot afford a lawyer in a felony case, ask the court to appoint one for you.
  • Contact your embassy or consulate — they can help you find a lawyer.
  • Do not answer detailed questions until your lawyer is present.

What should you NOT do?

  • Do not waive your right to a lawyer under pressure — you can always request one.
  • Do not confess or give a statement without legal advice — statements made without a lawyer can still be used against you.
  • Do not assume free lawyers are unavailable — the Oman Bar Association and legal aid organizations may help.
