What is this right?

Icelandic law provides protections against arbitrary deportation:

  • Non-refoulement: You will not be returned to a country where you face death penalty, torture, inhuman treatment, or serious harm from armed conflict.
  • Re-entry ban: Minimum 2 years; may be permanent depending on circumstances.

Appeal rights:

  • 15-day window from notification of the expulsion decision.
  • Appeals go to the Immigration and Asylum Appeals Board.
  • Automatic suspensive effect (deportation paused during appeal) for: residence/permanent residence permit holders, registered EEA/EFTA citizens, and Nordic citizens residing 3+ months.
  • Free legal representation is appointed by authorities.

The best interests of children receive special consideration in expulsion decisions.

When does it apply?

  • You have received a deportation or expulsion order from Icelandic authorities.

What should you do?

  • Appeal within 15 days — you will receive free legal representation.
  • If you fear persecution in your home country, raise non-refoulement as a defence.
  • Contact the Icelandic Red Cross or UNHCR for support.

What should you NOT do?

  • Don't miss the 15-day appeal deadline — it is strictly enforced.
  • Don't leave Iceland voluntarily if you intend to appeal — stay and exercise your appeal rights.
